Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the SuzeChef mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

SuzeChef reserves the right to modify these Terms at any time. We will notify you of material changes through the App or via email at least 30 days before they take effect. Your continued use of the App after any such modifications constitutes your acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years of age to create an account and use SuzeChef. By using the App, you represent and warrant that you meet this age requirement. If you are between 13 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

If we learn that we have collected personal information from a child under 13 without parental consent, we will promptly delete that information. If you believe a child under 13 has provided us with personal data, please contact us at suzechefai@gmail.com.

3. Description of Service

SuzeChef is a gamified cooking companion app available on iOS that allows users to:

  • Import recipes from URLs using AI-powered parsing
  • Create personalized recipe remixes based on dietary preferences
  • Cook step-by-step with interactive cook mode and timers
  • Plan meals with a weekly calendar and generate shopping lists
  • Track cooking progress, earn XP, and climb leaderboards
  • Grow and evolve Suze, your virtual axolotl cooking companion
  • Organize recipes into custom cookbooks

Some features are available only to users with a premium subscription. SuzeChef may add, modify, or discontinue features at any time.

4. User Accounts

4.1 Account Creation

To access SuzeChef features, you must create an account using Google or Apple Sign-In. You agree to provide accurate and complete information during registration and to keep your account information up to date.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify SuzeChef immediately of any unauthorized use of your account or any other breach of security. SuzeChef will not be liable for any loss or damage arising from your failure to secure your account.

4.3 Account Termination

SuzeChef reserves the right to suspend or terminate your account at any time for violation of these Terms, suspicious or fraudulent activity, or for any other reason at SuzeChef's sole discretion, with or without notice.

5. Subscriptions & Payment

5.1 Free and Premium Tiers

SuzeChef offers a free tier with core features and a Pro subscription that unlocks additional functionality:

  • Free tier: Basic recipe import, cook mode, and limited remixes
  • Pro tier ($9.99/month or $49.99/year): Unlimited remixes, meal planning, shopping lists, advanced stats, and leaderboard access

5.2 Billing

Payment for subscriptions is processed through Apple's App Store. By subscribing, you agree to Apple's terms of service and payment terms. All prices are in USD unless otherwise indicated and may vary by region.

5.3 Auto-Renewal

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

5.4 Cancellation & Refunds

You may cancel your subscription at any time through your device's App Store subscription settings. Cancellation takes effect at the end of the current billing period, and you will retain access to Pro features until that date. No refunds will be provided for partial billing periods. Refund requests are handled by Apple according to their refund policy.

5.5 Price Changes

SuzeChef reserves the right to modify subscription prices at any time. Price changes will be communicated at least 30 days before they take effect. If you do not agree with a price change, you may cancel your subscription before the new price applies.

5.6 Free Trials

SuzeChef may offer free trial periods for Pro features. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the standard rate.

6. User Content

6.1 Ownership

You retain ownership of all content you create, upload, or store in the App ("User Content"), including recipes, remixes, cookbooks, meal plans, and personal notes. SuzeChef does not claim ownership of your User Content.

6.2 License Grant

By using the App, you grant SuzeChef a worldwide, non-exclusive, royalty-free license to use, store, process, and transmit your User Content solely for the purpose of providing, maintaining, and improving the App's services. This license ends when you delete your content or your account.

6.3 User Responsibilities

You are solely responsible for your User Content. You agree not to upload or store content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable; that infringes on the intellectual property rights of others; or that contains viruses or other malicious code.

6.4 Content Moderation

SuzeChef reserves the right to review, modify, or remove any User Content that violates these Terms or applicable laws, at SuzeChef's sole discretion and without prior notice.

7. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse engineer, decompile, disassemble, or extract the source code of the App
  • Upload harmful, abusive, or inappropriate content
  • Interfere with or disrupt the App's services, servers, or connected networks
  • Create multiple accounts to manipulate leaderboards, XP, or gamification features
  • Use automated scripts, bots, or scrapers to access or interact with the App
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use the App for commercial purposes without prior written consent from SuzeChef
  • Circumvent, disable, or otherwise interfere with security-related features of the App

8. Intellectual Property

8.1 SuzeChef Property

The App, including its design, features, code, graphics, Suze the Axolotl character and all related artwork, animations, and evolution designs, and all other content (excluding User Content), are owned by SuzeChef and protected by copyright, trademark, and other intellectual property laws.

8.2 Recipe Content

Recipes imported from third-party URLs are provided for your personal use only. SuzeChef does not claim ownership of third-party recipe content but provides tools to help you organize, customize, and cook from your personal recipe collection. You are responsible for ensuring your use of imported recipes complies with the original source's terms.

8.3 Restrictions

You may not copy, modify, distribute, sell, or lease any part of the App or its content; reverse engineer or attempt to extract the source code; use SuzeChef branding, logos, or the Suze character without written permission; or remove any proprietary notices from the App.

9. AI-Powered Features

SuzeChef uses artificial intelligence (routed through third-party providers via OpenRouter) to parse recipes from URLs, generate personalized remixes, and provide nutritional estimates. You acknowledge and agree that:

  • AI-generated content may contain errors, inaccuracies, or incomplete information
  • Recipe parsing may not perfectly capture all ingredients, steps, or measurements from source material
  • Nutritional estimates are approximate and should not be relied upon for medical or dietary decisions
  • AI-generated remixes and substitutions may alter the taste, texture, or safety of a recipe
  • You are responsible for reviewing all AI-generated content before cooking

Recipe text you import is processed server-side via our backend. No personally identifiable information (name, email, account data, cooking history, or any data that could identify you) is ever shared with AI providers. Only recipe text, your dietary preferences, and any comments you provide during remixing are sent to the AI. See our Privacy Policy for full details on data handling.

10. Privacy & Data

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

SuzeChef collects and processes data including account information (name, email via Google or Apple Sign-In), recipes, remixes, and cookbooks you create, cooking sessions, XP progress, and evolution stats, meal plans and shopping lists, and usage analytics and device information.

11. Disclaimers & Warranties

11.1 As-Is Basis

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11.2 Recipe & Food Safety

SuzeChef is not responsible for the accuracy, safety, or suitability of recipes found, imported, or stored in the App. Users should always verify ingredients and cooking instructions independently, exercise caution with allergens and potential food safety concerns, consult a healthcare professional before making dietary changes, and not rely on the App as a substitute for professional nutritional or medical advice.

11.3 Service Availability

SuzeChef does not guarantee uninterrupted, secure, or error-free operation of the App. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

12. Limitation of Liability

To the maximum extent permitted by applicable law, SuzeChef shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the App
  • Any unauthorized access to or use of your account
  • Any errors, mistakes, or inaccuracies in the App's content, including AI-parsed recipes
  • Any loss or damage resulting from following recipes found in the App
  • Any interruption or cessation of the App's services
  • Any bugs, viruses, or other harmful code that may be transmitted through the App

In no event shall SuzeChef's total liability exceed the amount you paid for your subscription, if any, during the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless SuzeChef, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, your violation of any third-party rights, or your User Content.

14. Termination

14.1 By You

You may stop using the App at any time. You may delete your account and all associated data through the App's settings or by contacting us at suzechefai@gmail.com. Upon account deletion, your data will be removed from our systems within 30 days.

14.2 By SuzeChef

SuzeChef may terminate or suspend your account and access to the App at any time, without prior notice, for any reason, including but not limited to violation of these Terms, suspicious or fraudulent activity, extended period of inactivity, or technical or security reasons.

14.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. Sections of these Terms that by their nature should survive termination will survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

15. Governing Law & Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

15.2 Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the State of Delaware. The arbitrator's decision shall be final and binding.

15.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against SuzeChef.

16. General Provisions

16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and SuzeChef regarding your use of the App and supersede all prior agreements and understandings, whether written or oral.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16.3 Waiver

SuzeChef's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights under them without SuzeChef's prior written consent. SuzeChef may assign or transfer these Terms without restriction.

16.5 Force Majeure

SuzeChef shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, or pandemics.
